The power to revoke an academy order, that was made because a maintained school is eligible for intervention, is discretionary and is contained in Section 5(D) of the Academies Act 2010.
Each request to revoke is considered on a case-by-case basis and as set
out in the Schools Causing Concern guidance will only be used in very
exceptional circumstances – for example, where the maintained school is
not viable and therefore it is most appropriate for it to close.
